Terms of Sales :
These general terms and conditions apply to all offers made by JÏX.
The conditions are accessible to all and appear on the website https://www.jix-collection.com/.
By placing an order, you indicate that you accept the terms of delivery and payment. Jïx reserves the right to modify its terms of delivery and/or payment after the expiry of the deadline.
Unless otherwise agreed in writing, the general or specific conditions or stipulations of third parties are not recognized by Jïx.
JÏX guarantees that the product delivered complies with the agreement and the specifications mentioned in the offer.
Price :
The prices will not be increased during the duration of the offer, unless legal measures make it necessary or the manufacturer introduces temporary price increases.
All prices listed on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.
All prices listed on the site are in Euros and include 21% VAT.
Delivery :
Delivery takes place as long as stocks allow.
Within the framework of the rules of the law on distance selling, JÏX executes orders at least within 30 days.
If this is not possible (because the goods ordered are out of stock or no longer available), if there is a delay for other reasons or if an order cannot be fulfilled or cannot be be only partially, the consumer will receive a message within one month after placing the order and he will then have the right to cancel the order without charge or notice.
The place of delivery is the address that the consumer has made known to the company.
Unless proven otherwise, JÏX's delivery obligation is considered fulfilled as soon as the goods delivered by JÏX have been offered once to the buyer. In the case of home delivery, the carrier's report indicating that the goods have not been accepted constitutes full proof of the delivery offer.
All terms mentioned on the website are indicative. No rights can therefore be derived from the periods indicated.
Trial period / right of withdrawal:
In the event of a consumer purchase, according to the Distance Selling Act (Article 7:5 of the Civil Code), the buyer has the right to return (part of) the delivered goods within 14 working days. without stating the reason. This period begins when the ordered goods are delivered. If, at the end of this period, the Buyer has not returned the goods delivered to JÏX, the purchase is deemed to have taken place. Before returning the goods, the buyer must notify JÏX in writing within 14 working days of delivery. The customer must prove that the delivered goods have been returned on time, for example by means of proof of postage. Goods must be returned in their original packaging (including accessories and accompanying documentation) and in new condition. If the goods have been used, encumbered or damaged in any way by the buyer, the right of dissolution within the meaning of this paragraph lapses. Respecting the provisions of the previous sentence, JÏX will ensure that, within 14 working days of receipt of the return shipment, the total amount of the purchase, excluding the shipping costs which have been made, or reimbursed to the buyer. The return of the delivered goods is entirely at the buyer's expense and risk.
The right of withdrawal does not apply:
- To services whose execution, with the consent of the consumer, began before the period of seven working days.
- Goods or services whose price is linked to fluctuations in the financial market over which the supplier has no influence.
- Goods made to the consumer's specifications, for example bespoke goods, or which are clearly personal in nature.
- For goods or services which cannot be returned due to their nature, for example for reasons of hygiene, or which deteriorate or age rapidly.
- Despite all the care taken in putting our assortment of products online, the site www.jix-collection.com is not immune to the presence of erroneous content linked to confusing, incomplete, inaccurate information. or poorly written. Similarly, the site may be subject to occasional technical malfunctions. As soon as it becomes aware of them, JÏX makes every effort to remedy these shortcomings as soon as possible. JÏX declines all responsibility for direct or indirect damage, of a material or immaterial nature, caused by its site and related websites. Whether in terms of price, visuals or texts, errors found on the site do not give the buyer the right to cancel payment for a product or to demand any compensation. To any dispute from the buyer, JÏX will provide, with the greatest objectivity and keeping a commercial spirit, the solution it considers appropriate.
If the consumer makes use of his right of withdrawal, the return costs are his responsibility.
If the consumer buys an item on sale, he cannot make use of his right of withdrawal. Sales cannot be returned afterwards.
Data managment :
If you place an order with JÏX, your data will be included in a customer file. JÏX complies with the Personal Data Registration Act and will not provide your details to third parties. See our privacy policy .
JÏX respects the privacy of all users of the website and ensures that your personal data is treated confidentially.
Guarantee :
The customer is required to check the delivered goods upon receipt. If it turns out that the goods delivered are erroneous, inadequate or incomplete, the Buyer must "before returning the goods to JÏX" immediately notify these defects to JÏX in writing. Any defect or faulty goods delivered must be reported to JÏX in writing no later than 14 days after delivery. The return of the goods must be in the original packaging (including accessories and the corresponding documentation) and in new condition. The use after the observation of the failure, the damage occurring after the observation of the failure, the pledging and/or the resale after the observation of the failure, render this right of complaint and restitution completely null and void.
If JÏX deems the customer's complaints to be justified, JÏX may, at its discretion, either replace the delivered goods free of charge or enter into a written agreement with the customer regarding compensation, it being understood that JÏX's liability and, therefore, the amount of compensation will always be limited to a maximum of the invoice amount of the goods concerned or (at JÏX's discretion) the maximum amount covered by JÏX's liability insurance in the relevant case. Any liability of JÏX for any other form of damage is excluded, including further compensation in any form, compensation for indirect or consequential damages or damages due to loss of profits.
JÏX is not liable for any loss or damage caused by intent or equivalent willful recklessness on the part of non-management personnel.
This warranty does not apply if:
- The customer is in default vis-à-vis JÏX for as long as the customer is in default.
- The customer has repaired and/or modified the delivered goods himself or has had them repaired and/or modified by third parties.
- The goods delivered have been exposed to abnormal conditions or have been treated carelessly or contrary to JÏX's instructions and/or the instructions for use on the packaging.
- The inadequacy results in whole or in part from rules enacted or to be enacted by the authorities with regard to the nature or quality of the materials used.
Actions:
Shares are non-binding, unless otherwise specified in the offer.
In the event of acceptance of a non-binding offer by the buyer, JÏX reserves the right to revoke the offer or to deviate from it within 3 working days after receipt of this acceptance.
JÏX's verbal commitments are only binding after they have been explicitly confirmed in writing.
JÏX offers do not automatically apply to repeat orders.
JÏX cannot be held to its offer if the customer should have understood that the offer, or part of it, contains an obvious error or a material error.
Additions, changes and/or additional agreements are only effective if agreed in writing.
Commitment :
A commitment between JÏX and a customer is concluded after an order has been deemed feasible by JÏX. JÏX reserves the right, without giving reasons, not to accept orders or to accept them only on the condition that the shipment takes place against reimbursement or after prepayment. Unless otherwise agreed, amounts owed by the consumer must be paid within 14 days of delivery of the goods.
Pictures and Specifications:
All images, photos, drawings, etc., including product specifications on weights, dimensions, colors, label images, etc. appearing on the JÏX website only apply approximately, are indicative and cannot give rise to compensation or the dissolution of the contract.
Case of force majeure:
JÏX is not liable if and insofar as its obligations cannot be fulfilled due to force majeure.
Force majeure means any external cause, as well as any circumstance which, reasonably, should not be the responsibility of JÏX. Delay or failure to perform by our suppliers, internet disruptions, electricity disruptions, email traffic disruptions and disruptions or changes in technology provided by third parties, transportation difficulties , strikes, governmental measures, delays in delivery, negligence of suppliers and/or manufacturers of and auxiliaries, illness of personnel, deficiencies of auxiliary means or means of transport explicitly count as force majeure.
In the event of force majeure, JÏX reserves the right to suspend its obligations and is also entitled to partially or completely dissolve the agreement or to demand that the content of the agreement be modified in such a way that its execution remains possible. JÏX shall under no circumstances be required to pay any penalty or compensation.
If, at the time the force majeure occurs, JÏX has already partially fulfilled its obligations or can only partially fulfill them, it is entitled to invoice the already delivered part or the deliverable part separately and the buyer is obliged to pay this invoice as if it were a separate contract. However, this does not apply if the part already delivered or the deliverable has no independent value.
